  1. Introduction

    1. Trade Credit Underwriting Agency NZ Ltd Company Number 3978818 ("TCUA") has a commitment to privacy in accordance with the Privacy Act 1993 and the guidelines and policies of the New Zealand Privacy Commissioner. This Privacy Policy is provided to make you aware of how TCUA collects, uses and manages personal information.
    2. "Personal information" means information or an opinion recorded about an individual that makes the individual's identity reasonably apparent or ascertainable. TCUA views the privacy of personal information as an important issue.
    3. In making this Privacy Policy, TCUA does so on the basis that this policy does not replace or limit the requirements of the Privacy Act.
  2. Manner and purpose of collection of personal information

TCUA will only collect personal information that is directly related to and necessary for our dealings with that individual or in relation to the amount of credit risk in relation to credit being provided to a company with whom the relevant individual is associated. The type of information TCUA collects includes, but may not be limited to, the types of information referred to in the Privacy Act, information you provide to us at our request, your name and address and, when you use our web site, your domain name, email address, and information on what pages you access.
    2. TCUA will only use the personal information for the purposes of providing underwriting services to our customers, which includes the analysis, administration and processing of credit limits and insurance claims. Agents or contractors of TCUA who have access to the information you provide, are bound to keep the information confidential and not use it for any other purpose than to carry out the services they perform on behalf of TCUA. Personal data that relates to these activities is only collected and used where we have the written consent of the client unless:
      • the relevant individual has consented to us using his or her personal information for other purposes; or
      • its use for another purpose is required or permitted by law.
  3. Accuracy and completeness of personal information

    1. While TCUA will endeavour to ensure that the personal information collected from an individual is up to date and complete, TCUA will assume that any personal information provided by you is free from errors and omissions, is not misleading or deceptive and complies with all relevant laws.
    2. TCUA relies on the personal information provided by you. TCUA will not check or verify the accuracy of any personal information it obtains from you or other persons.
    3. You should provide TCUA with details of any changes to your personal information as soon as reasonably practicable following such change.
    4. In some instances, the personal information held by TCUA about you may incorporate or summarise views, guidelines or recommendations of third parties. TCUA will endeavour to assemble and record such personal information in good faith, but cannot guarantee that it will necessarily involve a considered review of the information.
  4. Distribution of your personal information

    1. TCUA does not permit the personal information it holds to be distributed to third parties unless:
      • it is to a third party which agrees to appropriate privacy restrictions with TCUA;
      • the relevant individual has consented or requested his or her personal information to be provided to a third party; or
      • TCUA is required or permitted by law to provide information to a third party.

    2. The Privacy Officer will endeavour to deal with your inquiry or complaint as soon as is reasonably practicable.
